The Release of the 2023 Title IX Regulations

Notice: Possible Delay of Release of 2023 Title IX Regulations

The amended Title IX regulations were initially anticipated to be released in May and then October 2023. However, the Department of Education has yet to submit the final regulations to the Office of Management and Budget (OMB) for mandatory review by the Office of Information and Regulatory Affairs (OIRA). This review can take up to 120 days, possibly extending completion and release of the “new” Title IX to late 2023 or early 2024. Furthermore, additional time may be needed to accommodate OIRA’s recommendations.

With the complexity of proposals and extensive feedback received – 240,000 comments on the broad Title IX proposal and 150,000 on athletics-related regulation – the DOE faces deliberative challenges. While an October 2023 release date remains a slim possibility, experts acknowledge OIRA’s discretion for an expedited review and the likelihood of a late 2023 or early 2024 release of the regulations. The DOE has not yet issued an official statement.
