Session One: Overview of the New Title IX Regulations (1 hour)

This opening presentation reviews the recently adopted Title IX regulations, including the three-pronged definition of sexual harassment, a school’s obligation to provide supportive measures, the formal complaint process, investigations, informal resolution options, standards of evidence, and hearings.

Session Two: Title IX Investigation Procedures & Best Practices (1 hour)

A review of the guidelines for investigations under the recently released Title IX regulations is be coupled with guidance from experienced investigators on the practical aspects of conducting an investigation into an alleged incident of sexual harassment. Topics include designing an investigation plan, gathering evidence, interviewing witnesses, maintaining an investigation record, determining the relevance of information developed during an investigation, and writing an investigation report.

Session Three: Informal Resolutions (1 hour)

Speakers: Robert D. Litz, JD, James W. Reeves, JD LLM, Michael Geigerman, JD

This session discusses informal resolution processes, sometimes referred to as Alternative Dispute Resolution (ADR), including mediation, arbitration and restorative justice. The program covers a detailed discussion of the mediation process, including preparation before mediation, what to expect during mediation and the role of the mediator. It also covers specific requirements of 34 CFR Section 106.45(b)(9).

Session Four: Hearing Processes & Determining Relevance (1 hour)

Speakers: Kim L. Kirn, JD, Melvin Kennedy, JD MPA, Honorable Patricia A. Riehl

This presentation covers the hearing process under 34 CFR Section 106.45(b)6), including selection of the Decision Maker (hearing officer), pre-hearing issues and hearing procedures. The discussion also covers determining relevant evidence and cross examination of witnesses, as well as the appeal process and requirements under 34 CFR Section 106.45(b)(8).

Session Five: Risk Management & Litigation Analysis (1 hour)

Speaker: Whitney M. Dowdy

In this session Whitney Dowdy identifies specific areas of risk under Title IX for your institution and ways to reduce that risk. Dowdy engages in a discussion on understanding your institution’s policy, procedures, and the rights and responsibilities of all parties, as well as best practices to implement. Dowdy also examines current case law and discuss trends in Title IX litigation to help you avoid similar outcomes.

Session Six: Strategies for Establishing Rapport & Optimizing Interviews (1 hour 20 minutes)

Speakers: Isaac A. (Ron) Bratcher III & Thomas A. Denton, Jr.

Experienced investigators address techniques for establishing rapport with parties and other interview skills to help investigators optimize information developed during interviews while treating complainants, respondents, and witnesses with respect. Topics include the role of advisors, working as an investigative team, the significance of school policy, gathering electronic evidence, recognizing and addressing conflicts of interest and potential implicit and explicit biases, and cyber interviews.

Session Seven: Mock Mediation (1 hour)

Facilitators: Kenneth M Chackes, JD & Michael S. Geigerman, JD

Viewers have the opportunity to observe a Title IX mediation involving a complainant, respondent, and school representative, each accompanied by their advisors. Throughout the mock mediation, the participants step out of their roles to explain and critique the mediation process and provide advice to assist attendees in understanding how the mediation process may be beneficial in addressing Title IX cases on their campuses.

Session Eight: Mock Hearing (1 hour)

Facilitator: Judge Michael T. Jamison

An experienced trial court judge and mediator serves as the decision-maker in this mock hearing, which includes a complainant and respondent with their advisors. The parties and advisors present evidence and conduct cross-examination while the decision-maker decides issues of relevance. Throughout the hearing, the parties discuss issues related to the hearing and share insights and advice with program participants.

Session Nine: Role-Playing Scenario with a Professional Investigator (1 hour 17 minutes)

Facilitators: Thomas A. Denton, Jr. & Patrick B. Mathis, JD LLM MBA

Join Thomas A. Denton, professional Title IX investigator, as he interviews complainant Elena. During the interview, Patrick B. Mathis interjects with explanations for Tom’s questioning patterns. At the end, Tom further explains his approach to the interview and Elena expresses her thoughts as the complainant.

Session Ten: Trauma-Informed Interview Techniques & Q&A with Trauma-Informed Response Expert (3 hours)

Speaker: Chief Thomas R. Tremblay (Ret)

The trauma-informed victim / complainant interview is grounded in responsiveness to the impact of trauma. By understanding trauma, all those who work with victims / complainants can contribute to their immediate and long-term recovery and lay the foundation for mutual cooperation, respect, and trust for which a successful interview is built. Helpful communication strategies and interview skills to help capture the victim / complainant experience will be shared including exploring sensory details, reframing questions to avoid blaming language and tone, and interviewing for clarification of facts and evidence.

After  presenting about trauma-informed interview techniques, Tom Tremblay leads participants through a one-hour conversation about communicating with parties.

Grievance Process Objectives:

• Understand the neutral hearing process, including the responsibilities of the decision- maker.
• Understand each party’s right to an advisor and the process for asking relevant questions during cross-examination of parties
• Review standards decision-makers are to follow that are set by the school, including “preponderance of evidence” or “clear and convincing” standards.
• Understand the appeal process, including grounds to appeal, required notices and opportunities to submit written arguments.
• Gain a general understanding of various informal resolution processes
• Learn practical techniques in preparation for and during mediation toward a goal of resolving Title IX complaints
• Understand the applicability of informal resolution processes to resolve Title IX complaints and the timing of when to mediate

This training will not include institutional-specific training or individualized assessments of policies and procedures.

ISAAC A. (RON) BRATCHER III

During his 28 year 9 month career with the Federal Bureau of Investigation, Ron investigated numerous violations of federal law, including: Bank Fraud, Bankruptcy Fraud, Public Corruption, Child Pornography, Bank Robbery, Bank Robbery Resulting in Death, Drug Violations, Domestic Terrorism, International Terrorism, and Crimes on United States Reservation (United States Prison).  During these investigations, Ron recorded over a thousand conversations between sources and subjects and conducted thousands of covert surveillances. Ron applied for, received, and executed hundreds of search warrants and arrest warrants. He also provided testimony before Grand Juries and at trials hundreds of times.

 As a Task Force Coordinator, Ron was responsible for organizing individuals from multiple Police/Sheriff’s Departments and directing those individuals toward investigating Federal crimes. As a Task Force Coordinator and a Case Agent, Ron was responsible for locating and interviewing witnesses/subjects, preparing reports of interviews, completing financial analysis, collecting and processing items of interest (evidence), attending autopsies, downloading and analyzing cellular telephone data, serving subpoenas, analyzing subpoenaed data, preparing exhibits, and preparing prosecutive reports.

During his employment as a Federal Bureau of Investigation Special Agent, Ron was trained to use Cellebrite Universal Forensic Extraction Device. Ron used the device to download and analyze well over a hundred cellular telephones for Federal, State, and Local investigators.

Ken Chackes has served as a mediator in over 175 cases over the last 20 years, primarily in the areas of education, employment and civil rights. He also has represented parties in more than 100 additional mediations as part of his litigation practice. Ken is a Qualified Mediator for the Missouri Department of Elementary and Secondary Education; the U.S. Equal Employment Opportunity Commission; the U.S. District Court, Eastern District of Missouri; and the Circuit Court for the City of St. Louis.

Ken also has significant litigation experience, specializing in employment discrimination, disability law, education law, civil rights, sexual abuse, and other civil matters.

Tom Denton is a founding member of Title IX Solutions, LLC and Tactical 97 Group, LLC. He is a retired Chief of Police and career law enforcement officer with over 31 years of public service with municipal, state, and federal law enforcement agencies. In 2005, he founded Tactical Investigations, LLC and has been a licensed private detective for 15 years. Tom has extensive experience investigating child sexual assaults and Title IX violations. He has received specialized training in Forensic Child Interviewing and state-of-the-art Trauma Informed Interviewing techniques and is a certified Title IX Investigator.

Tom was a sworn Special Federal Officer with an F.B.I. Violent Crimes Task Force in the Southern District of Illinois. He specialized in electronic surveillance and suspect interviews. Tom investigated organized criminal enterprises concentrating on large scale drug trafficking, weapons, and gang violence.

Tom is a leader in many local and national organizations. He is a Life Member of the Illinois and International Association of Chiefs of Police. He currently serves as Vice President (Central Chapter) of Associated Detectives and Security Agencies of Illinois, President of Illinois Association of Professional Process Servers, and is an active member of the National Council of Investigation and Security Services, National Association of Professional Process Servers and Association of Title IX Administrators.

WHITNEY M. DOWDY, JD

As a shareholder in the Memphis office of Baker Donelson, Ms. Dowdy has extensive experience representing clients in employment matters before the Equal Employment Opportunity Commission, the Department of Labor, state agencies, and in various state and federal courts.

Ms. Dowdy’s work for employers includes drafting employee handbooks and policies, training supervisors and managers on the implementation of these policies, and providing guidance and advice on current employment-related legislation and agency initiatives. Ms. Dowdy has successfully defended employers against employee claims and audits by the Equal Employment Opportunity Commission, the Department of Labor’s Wage and Hour Division, the Occupational Safety & Health Administration, the Office of Federal Contract Compliance Programs, and various other state and federal agencies.

Ms. Dowdy also regularly advises higher education institutions on matters related to Title IX. Specifically, Ms. Dowdy serves as a Title IX investigator and provides training on Title IX investigations for higher education institutions.

MICHAEL S. GEIGERMAN, JD

Mr. Geigerman is the Managing Director of USA&M and has mediated over 4,400 mediations since 1986. His vast experience ranges from abuse to wrongful termination, as well as serious personal injury (involving numerous seven and eight figure settlements), professional malpractice, clergy and school abuse, police brutality, employment discrimination (racial, sex, age and ADA) multi-cultural conflicts and first amendment claims.  Mike is also called upon to serve as arbitrator in difficult cases.

He serves as a qualified neutral for the U.S. District Court, Eastern District of Missouri. He has been an Adjunct Professor at Washington University School of Law since 2000. Mike has been selected as a Best Lawyer in America (in mediation) since 2007 and a Missouri Super Attorney (in mediation) since 2000 and voted the Best Mediator in Missouri in 2008; Best Arbitrator/Mediator in 2009 and the best Mediator in St. Louis in 2017.

Michael T. Jamison retired as a Circuit Judge for the State of Missouri in December 2019 after twenty-two years on the bench. He is a mediator with United States Arbitration & Mediation. Mr. Jamison is an Adjunct Professor for St. Louis Community College. He has taught Business Law, Employment Law, Contracts and Administrative Law, as well as Economics.

Mr. Jamison previously engaged in the corporate practice of law as an Associate General Counsel in the Labor Law Section of the Legal Department of Anheuser-Busch Companies from 1994 to 1997. 

Mr. Jamison was employed as a Field Attorney, Trial Specialist with the National Labor Relations Board from 1976-1992, where he handled numerous unfair labor practice investigations and litigation.

Mr. Jamison was a senior associate with the Law Firm of Lashly & Baer, P.C. for two years after leaving the federal government. His practice consisted of labor and employment law, governmental law, and education law on behalf of the St. Louis Public Schools.

Mr. Kennedy has been admitted to practice law in Missouri and Illinois since 1993. He has practiced in the areas of employment discrimination, bankruptcy/creditors’ rights and criminal defense. Mr. Kennedy has represented both employers and employees in employment discrimination cases. For fourteen (14) years, he worked as a Senior Trial Attorney for the U.S. Equal Employment Opportunity Commission (EEOC). As a mediator, Mr. Kennedy has mediated employment disputes throughout Missouri, Kansas, Illinois, Oklahoma and Nebraska. KIM L. KIRN, JD

Kim Kirn is a full-time mediator and arbitrator with hundreds of completed cases relating to education including special education, American with Disabilities Act, housing, affirmative action, tenure, sexual harassment and employment.  Kim frequently acts as a Fact-Finder for the Illinois State Universities Civil Service System and previously served as a Hearing Board Member for the  Illinois Attorney Registration and Disciplinary Commission (ARDC)  Her work with the Civil Service System requires that she act as a mediator to see if resolution is possible before beginning the hearing.  This unique experience in conducting mediation-arbitrations, sometimes referred to as Med-Arb can be cost effective and very attractive to the parties looking to resolve disputes in one day or less.

Kim is an honors graduate of University of Missouri-Columbia and Notre Dame Law School; she and her husband, David George, have two adult sons and a dog, all of whom are frequent targets of her mediation skills. She served two terms as a publicly elected Glen Carbon Library Trustee.

ROBERT D. LITZ, JD

Mr. Litz is an experienced civil trial lawyer, arbitrator, mediator, civil service hearing officer and President of USA&M.  He has arbitrated and mediated cases involving employment, including sex, age, sexual orientation and race discrimination, as well as breach of contract, real estate, partnership dissolution, personal injury, loan defaults, general corporate, securities, environmental, products liability and computer contract matters.

 Patrick B. Mathis is the Co-Founder & Managing Member at Title IX Solutions, LLC as well as a founding shareholder of Mathis, Marifian & Richter, Ltd. (MM&R), a law firm based in Southern Illinois and St. Louis, Missouri.

With over 30 years of legal experience, Pat has an extensive background in providing legal counsel related to business mergers, sales and acquisitions, shareholder litigation, trusts and wills, probate, federal and state tax audits and appeals, Tax Court litigation, and criminal tax defense. He has written several definitive articles on various aspects of each area.

As Managing Member of Title IX Solutions, LLC (“TIXS”), Pat brings his extensive legal experience to TIXS clients and investigators. Having advised clients on a wide variety of legal issues, he has a developed awareness of the broad implications of incidents which may affect complainants, respondents, and educational institutions. With that understanding, he is able to work with colleges, Title IX Coordinators, school counsel, and TIXS investigators to develop a comprehensive understanding and approach to addressing the issues which arise in incidents of alleged sexual assaults to ensure prompt and equitable resolutions.

Pat also coordinates the training of our investigators regarding the legal aspects of Title IX, DOE guidelines, state law issues, and related areas.

Pat has conducted numerous seminars and educational programs for IICLE and the American, Illinois State and Metropolitan St. Louis Bar Associations. Pat has been named to Illinois’ Leading Lawyers and Illinois Super Lawyers for several consecutive years, as well as to Who’s Who in American Law. Jim Reeves has been a mediator for almost 30 years.  He mediates business and legal disputes involving employment and workplace, general tort liability, medical malpractice, products liability , condemnation, family business issues, partnership disputes, and general business and commercial disputes. Jim also has expertise convening multi-party processes to resolve legal, organizational, community, and public policy disputes.  Jim was a litigation attorney for over 20 years and has operated his own firm providing mediation, facilitation, and conflict management services to individuals, businesses, and not-for-profit organizations.  He has also held executive management positions in corporate and small business environments.  He is a Lecturer in Law at Washington University in St. Louis where he teaches several ADR courses, including Mediation Theory & Practice, and Multi-Party and Public Policy Dispute Resolution.  He was also an adjunct professor of law at St. Louis University where he taught Civil Practice and Negotiation. 

Jim has served on the mediation panels of United States Arbitration & Mediation, the Equal Employment Opportunity Commission, the United States Veterans Administration, the National Archives and Records Administration, the Missouri Department of Elementary and Secondary Education, St. Louis Volunteer Lawyers and Accountants for the Arts, and various federal and state courts.  He is also a volunteer facilitator in the Victim-Offender Dialogue Program in the St. Louis County (Missouri) Family Court, Juvenile Division.  He is a member of the Missouri Bar ADR Committee former Chair; Bar Association of Metropolitan St. Louis ADR Committee former Chair; Association of Missouri Mediators former President, Human Resource Management Association, and the St. Louis Organization Development Network. He is licensed to practice law in Missouri, Illinois, and Colorado.

Education: Jim received his LL.M. (Master of Laws) degree from the University of Missouri-Columbia in 2004, where he focused on conflict resolution and organizational leadership and change, his J.D. from St. Louis University in 1984, and his B.S. from the University of Central Missouri in 1980. Jim received training in mediation from CDR Associates in Boulder, CO in 1991 and returned to CDR Associates for training in conflict management systems design in 1995.  He has also received advanced mediation training from United States Arbitration & Mediation in 1996, 2001, 2002, 2004, and 2005.

HONORABLE PATRICIA A. RIEHL

Missouri Circuit Judge (Ret), Mediator & Arbitrator

Judge Patricia Riehl is a retired Missouri Circuit Judge from the 23rd Judicial Circuit, Hillsboro, Mo.  She has held the positions of municipal judge, commissioner, associate circuit judge and circuit judge during her career.  She is most noted for her work in restorative justice having implemented and managed five different problem solving courts during her tenure on the bench.  She has previously served as a hearing officer for local municipalities regarding personnel disputes and was appointed a disciplinary hearing officer for the Missouri Supreme Court.  She is currently working as a mediator and arbitrator for USA&M.

Education: Southeast Missouri State University, summa cum laude, 1979; University of Missouri at Kansas City School of Law, with distinction, 1982; 23rd Judicial Circuit Mediation training 2000; mediation training Robert Benjamin, 2000.

CHIEF THOMAS R. TREMBLAY (RET)

Throughout his distinguished thirty-year policing career as an officer, detective, supervisor, police chief, and state public safety commissioner, Tom Tremblay has been a passionate leader for the prevention of domestic and sexual violence.  He is a retired Chief of Police from Burlington, VT, and a former Commissioner of the Vermont Department of Public Safety.  Tom is now a highly regarded national and international advisor and trainer for police, prosecutors, advocates, higher education, the military, and the private sector. 

Tom is a national leader in the development and delivery of Trauma-Informed Sexual Assault Investigations and Interview Training.  He assisted the International Association of Chiefs of Police with the development and delivery of a national curriculum for Trauma-Informed Response to Sexual Assault.  He also assisted the National Center for Campus Public Safety with the White House Task Force recommendation to develop a new curriculum for Trauma-Informed Sexual Misconduct Investigations and Adjudications specific for Colleges and Universities across the country.

Tom holds a Bachelor’s Degree in Criminal Justice.  He is a graduate of the 183^rd Session of the FBI National Academy, the FBI Law Enforcement Executive Development Seminar, the Police Executive Research Forum–Senior Management Institute for Police, and the National Law Enforcement Leadership Institute on Violence Against Women.
