News of potential restructuring within the U.S. Department of Education has raised understandable questions across campuses—particularly regarding the future of the Office for Civil Rights (OCR), the agency that currently oversees Title IX enforcement and compliance. Several proposals have suggested redistributing or absorbing parts of the Department’s responsibilities into other federal agencies. In fact, four areas within DOE already have been moved to other agencies. There have been indications that the responsibilities of OCR could be shifted to the Department of Justice.  However, no decision regarding the Office of Civil Rights has been finalized. While these conversations continue, it is important to recognize that institutions’ core responsibilities under Title IX remain unchanged.

Your campus community still relies on you to provide clear processes, equitable treatment, and a safe environment. And even as national discussions unfold, the work you do every day ensures that students and employees have the protections Title IX guarantees.

What We Know (and What We Don’t Know Yet) About Title IX Oversight

Federal leaders have expressed interest in reorganizing the Department of Education, prompting speculation about how OCR’s oversight could shift. At this stage:

  • No changes have been made to the Title IX Regulations, and Title IX obligations for institutions remain the same.
  • Any restructuring would take time, detailed planning, and further clarification.
  • Institutions continue to be responsible for nondiscrimination, prompt response to reports, and equitable resolution processes.

If the responsibilities of the Department of Education eventually become more distributed, institutions may see increased involvement from courts, attorneys, or independent entities in evaluating the fairness and defensibility of campus processes. But accountability will continue—simply potentially through different channels.

What This Means for Title IX Coordinators and Campus Leaders

Regardless of federal-level discussions, students and employees look to their institution for clarity, fairness, and consistency. That makes the work of Title IX professionals especially important during periods of change.

Institutions must continue to:

  • Maintain fair, well-documented Title IX procedures
  • Ensure staff understand their responsibilities
  • Keep policies aligned with current Title IX regulations
  • Communicate clearly and consistently with their communities
  • Prioritize the safety and equitable treatment for all community members
