We understand that implementing Title IX on your campus is more complicated than ever. Not only do the 2024 Title IX Regulations require significant revision to policies, procedures, and trainings, but hundreds of schools are not able or allowed to implement the new regulations due to court-ordered injunctions, directives from state officials or agencies, and/or ongoing litigation.

Injunctions cite concerns over the Department of Education’s potential overreach in its updated definition of sex, which was revised to include discrimination on the basis of sex stereotypes, sex characteristics, pregnancy or related conditions, sexual orientation, and gender identity. The new definition of hostile environment harassment as well as prohibiting schools from preventing individuals from accessing certain sex-separated spaces consistent with their gender identity are also referenced as points of concern in the injunctions and litigation.

Although a lot about Title IX is uncertain at the moment, one thing remains true. Title IX administrators must be trained, capable, and confident when implementing Title IX (whichever version applies to your campus!).
